1. Agreement to Terms

By accessing or using IndieMoves.ai ("Platform," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Platform.

2. Description of Service

IndieMoves.ai is a community platform for independent filmmakers who use artificial intelligence to create movies. The Platform allows users to:

  • Upload, share, and showcase AI-generated films and content
  • Connect with other filmmakers and community members
  • Discover and engage with creative content
  • Participate in discussions and collaborations

3. Eligibility

You must be at least 16 years old to use this Platform. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

4.1 Account Creation

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized use

4.2 Account Termination

  • You may terminate your account at any time through account settings
  • We may suspend or terminate your account for violations of these Terms
  • Upon termination, your right to use the Platform ceases immediately

5. Intellectual Property and Content Ownership

5.1 Your Content Ownership

You retain all rights, title, and interest in your content. When you upload content to IndieMoves.ai:

  • You own your movies, videos, images, text, and all creative works
  • We do not claim any ownership over your content
  • You are free to use, distribute, or monetize your content elsewhere

5.2 License You Grant to Us

By uploading content, you grant IndieMoves.ai a limited, non-exclusive, royalty-free, worldwide license to:

  • Host, store, and display your content on the Platform
  • Distribute your content through our CDN and infrastructure
  • Create thumbnails and preview images
  • Allow other users to view, stream, and interact with your content
  • Promote your content within the Platform (e.g., featured sections, recommendations)

This license:

  • Exists only to operate and improve the Platform
  • Terminates when you delete your content (subject to technical deletion timelines)
  • Does not grant us rights to use your content for commercial purposes outside the Platform

5.3 Public Content

Content you upload is publicly accessible unless explicitly marked as private (if such feature is available). By making content public, you grant other users permission to:

  • View and stream your content
  • Share links to your content
  • Comment on and discuss your content

5.4 Your Warranties

By uploading content, you warrant that:

  • You own or have all necessary rights to the content
  • Your content does not infringe any third-party intellectual property rights
  • You have obtained all necessary licenses for AI-generated content, including licenses for any training data, models, or tools used
  • Your content complies with all applicable laws and these Terms

5.5 Platform Intellectual Property

The Platform itself (including design, software, logos, trademarks) is owned by IndieMoves.ai and protected by copyright, trademark, and other intellectual property laws.

6. AI-Generated Content Guidelines

6.1 AI Disclosure

  • Content created using AI tools should be clearly identified as AI-generated where applicable
  • Users should be transparent about their creative process when sharing insights

6.2 AI Ethics and Responsible Use

When creating AI-generated content, you agree to:

  • Not use AI to create deepfakes or misleading content impersonating real individuals without consent
  • Not generate content depicting minors in inappropriate situations
  • Respect intellectual property rights when using AI models trained on copyrighted works
  • Follow applicable laws regarding AI-generated content in your jurisdiction

6.3 Third-Party AI Tools

  • You are responsible for complying with the terms of any third-party AI tools you use
  • You ensure you have proper licenses for any AI-generated content you upload

7. Acceptable Use Policy

You agree NOT to:

7.1 Prohibited Content

  • Upload illegal, harmful, threatening, abusive, or hateful content
  • Post content that infringes intellectual property rights
  • Share sexually explicit content involving minors
  • Distribute malware, viruses, or malicious code
  • Post spam, scams, or fraudulent content
  • Upload content promoting violence, terrorism, or illegal activities

7.2 Prohibited Conduct

  • Harass, bully, or threaten other users
  • Impersonate any person or entity
  • Manipulate platform features (fake engagement, vote manipulation)
  • Scrape or harvest user data without permission
  • Attempt to gain unauthorized access to the Platform or other users' accounts
  • Interfere with or disrupt the Platform's operation

7.3 Copyright Infringement

  • Do not upload content you don't have rights to use
  • Respect others' intellectual property rights
  • See Section 9 for DMCA/Copyright procedures

8. Content Moderation

8.1 Our Rights

We reserve the right to:

  • Remove or refuse to publish any content that violates these Terms
  • Suspend or terminate accounts for violations
  • Moderate, edit, or remove content at our discretion
  • Investigate potential violations

8.2 No Obligation to Monitor

We are not obligated to monitor all content but may do so to ensure compliance with these Terms.

8.3 User Reports

Users can report content that violates these Terms. We will review reports and take appropriate action.

9. Copyright and DMCA Compliance

9.1 Reporting Copyright Infringement

If you believe content on our Platform infringes your copyright, submit a notice to [copyright@indiemovies.ai] with:

  • Your contact information
  • Description of the copyrighted work
  • URL of the allegedly infringing content
  • Statement of good faith belief that use is unauthorized
  • Statement that the information is accurate and you're authorized to act
  • Your physical or electronic signature

9.2 Counter-Notice

If your content is removed due to a copyright claim, you may submit a counter-notice if you believe the removal was erroneous.

9.3 Repeat Infringer Policy

We will terminate accounts of users who repeatedly infringe copyrights.

10. Disclaimers and Limitations of Liability

10.1 "AS IS" Service

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 No Guarantee of Availability

We do not guarantee:

  • Uninterrupted or error-free service
  • Content accuracy, reliability, or quality
  • Security against unauthorized access
  • That defects will be corrected

10.3 User Content Disclaimer

  • We are not responsible for user-generated content
  • We do not endorse any user content or opinions
  • Users are solely responsible for their content

10.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED €100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (WHICHEVER IS GREATER)
  • WE ARE NOT LIABLE FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES

10.5 Exceptions

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless IndieMoves.ai, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your content
  • Your violation of these Terms
  • Your violation of any third-party rights

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

13. Modifications to Service and Terms

We may modify, suspend, or discontinue any part of the Platform at any time without liability.

13.2 Terms Changes

We may update these Terms by:

  • Continued use after changes constitutes acceptance

14. Dispute Resolution and Governing Law

Any disputes shall be resolved in the courts of Denmark, Hørsholm.

15. General Provisions

These Terms, together with the Privacy Policy, constitute the entire agreement between you and IndieMoves.ai.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

15.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.

15.5 Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control.
